In the following, we would like to inform you which personal data is generated by a visit to our website, how we process or use this data, and which rights you have under data protection law (EU Data Protection Regulation (DSGVO) and Federal Data Protection Act (BDSG)) you have as a user of the website towards Salm-Salm & Partner GmbH.

In principle, we collect, process and use your personal data only in accordance with the statutory regulations. Personal data when visiting our website are data that are only generated by accessing our website and have a reference to your person.

II. general information on data processing 

1. scope of the processing of personal data 

As a matter of principle, we process personal data of our users only to the extent that this is necessary for a functioning website as well as for our contents and services. We regularly process personal data of our users only with the consent of the user. An exception to this are cases in which obtaining prior consent is not possible for actual reasons and the processing of the data is permitted by legal regulations.

2. legal basis for the processing of personal data 

Insofar as we obtain the consent of the data subject for processing operations of personal data, the legal basis is Article 6 (1) lit. a of the EU General Data Protection Regulation (DSGVO).

When processing personal data that is necessary for the performance of a contract to which the data subject is a party, the legal basis is Art. 6 (1) lit. b DSGVO. This also applies to processing operations that are necessary for the performance of pre-contractual measures.

If processing of personal data is necessary for compliance with a legal obligation to which our company is subject, the legal basis is Art. 6 (1) c DSGVO.

If processing is necessary to protect a legitimate interest of our company or a third party and the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, the legal basis is Art. 6 (1) lit. f DSGVO. 

3. Data deletion and storage period 

We delete or block personal data as soon as the purpose of storage ceases to apply. We store data beyond this if this is provided for by the European or national legislator in Union regulations, laws or other provisions. We also delete or block data when a prescribed storage period expires, unless longer storage of the data is necessary for the conclusion or fulfillment of a contract. 

III. provision of the website and creation of log files

Each time our website is called up at https://www.salm-salm.de, the provider automatically records data and information from the computer system of the calling computer. These are:

the operating system of the user 
the Internet service provider of the user 
the IP address of the user 
date and time of access 
the Internet site from which the user's system accesses our Internet site
Internet pages that are accessed by the user's system via our Internet site 
This data is also stored by the provider in the log files of our system. We do not store this data together with other personal data of the user.

The legal basis for the temporary storage of the data and the log files is Art. 6 para. 1 lit. f DSGVO. 

3. purpose of data processing 

Temporary storage of the IP address by our system is technically necessary in order to deliver our website to the user's computer. For this purpose, the user's IP address must remain stored for the duration of the session. 

We store this data in log files to ensure the functionality of the website. In addition, we use the data to improve the website and to ensure the integrity and security of our information technology systems. This is also our legitimate interest in data processing (Art. 6 para. 1 lit. f DSGVO). 

We do not evaluate this data for the purposes of market research or advertising and do not pass it on to third parties for the purposes of market research or advertising.

4 Duration of storage 

The data will be deleted as soon as the purpose for which it was collected no longer applies. This is the case when the respective session has ended.

If the data is stored in log files, this is the case after seven days at the latest. Longer storage is possible. In this case, the IP addresses of the users are deleted or alienated so that we can no longer assign the calling client. 

5. possibility of objection and elimination 

The collection of data so that we can provide the website and the storage of the data in log files are absolutely necessary for the operation of the website. Therefore, the user has no possibility to object. 

IV. Use of cookies

Our website uses cookies. Cookies are text files that are stored in the Internet browser or by the Internet browser on the user's computer system. When a user calls up a website, a cookie may be stored on the user's operating system. This cookie contains a characteristic string of characters that enables the browser to be uniquely identified when the Internet page is called up again. 

For the operation of our website, we only use session cookies. These store a so-called session ID, with which various requests of your browser can be assigned to the common session. This allows your computer to be recognized when you return to the website. The session cookies are deleted when you close the browser.

The legal basis for the processing of personal data using cookies is Art. 6 (1) lit. f DSGVO. 

3 Purpose of data processing 

Cookies are used to simplify the use of Internet pages for users. We cannot offer some functions of our website without the use of cookies. For this purpose, it is sometimes necessary that the browser is recognized even after a page change. 

We do not use the user data collected by technically necessary cookies to create user profiles. 

4. duration of storage, possibility of objection and removal 

Cookies are stored on the user's computer and transmitted from it to our website. Therefore, you as a user also have full control over the use of cookies. By changing the settings in your Internet browser, you can disable or restrict the transmission of cookies. You can delete cookies that have already been stored at any time. You can also automate this. If you as a user deactivate cookies for our website, you may no longer be able to fully use all the functions of the website.

V. Contact form and e-mail contact

There is a contact form on our website that you can use to contact us electronically. If you take advantage of this option, the data you enter in the input mask will be transmitted to us and stored.

At the time of sending the message, the following data are also stored:

date and time of registration.
For the processing of the data, your consent is obtained during the sending process and reference is made to this privacy policy. 

Alternatively, you can contact us via the e-mail address provided there. In this case, the user's personal data transmitted with the e-mail will be stored. 

We do not pass on your data collected in this context to third parties. We use the data exclusively for processing the communication.

The legal basis for the processing of the data is Art. 6 para. 1 lit. a DSGVO if the user has given his consent. 

The legal basis for the processing of data transmitted in the course of sending an e-mail is Art. 6 (1) lit. f DSGVO. If the e-mail contact aims at the conclusion of a contract, the additional legal basis for the processing is Art. 6 para. 1 lit. b DSGVO. 

3. purpose of the data processing 

The processing of the personal data from the input mask serves us solely to process the contact. If contact is made by e-mail, this is also our legitimate interest in processing the data.

The other personal data processed during the sending process serve to prevent misuse of the contact form and to ensure the integrity and security of our information technology systems. 

4. duration of storage 

The data is deleted as soon as the purpose for which it was collected no longer applies. For the personal data from the input mask of the contact form and for those sent by e-mail, this is the case when the respective communication with the user has ended. 

The additional personal data collected during the sending process (e.g. IP address) will be deleted after a period of seven days at the latest. 

5. possibility of objection and removal 

As a user, you have the option to revoke your consent to the processing of personal data at any time. If you contact us by e-mail, you can object to the storage of your personal data at any time. In this case, however, we will not be able to continue the communication. 

All personal data stored in the course of contacting us will be deleted in this case. 

VI. Rights of the data subject 

As soon as we process personal data from you, you are a data subject within the meaning of the GDPR. This means that you have the following rights vis-à-vis us:

You have the right under Art. 77 DSGVO to lodge a complaint with a data protection supervisory authority about our processing of your personal data.

I. reCaptcha

We use the Google service reCaptcha to determine whether a human or a computer makes a certain entry in our contact or newsletter form. Google uses the following data to check whether you are a human or a computer: IP address of the terminal device used, the website you visit with us on which the captcha is embedded, the date and duration of the visit, the recognition data of the browser and operating system type used, Google account if you are logged in to Google, mouse movements on the reCaptcha areas and tasks that require you to identify images. The legal basis for the described data processing is Art. 6 (1) lit. f of the General Data Protection Regulation. There is a legitimate interest on our side in this data processing to ensure the security of our website and to protect us from automated entries (attacks).
